I. The following ‘Terms and Conditions’ statement applies to all use of Tibako.com website as well as to any products purchased from it.
II. By placing an order and/or signing up for an account or newsletter with us, you agree to have revised, understood and accepted these terms and conditions.
III. Our terms and conditions may be subject to change at any time without notice. Therefore, we suggest as your responsibility to check this page prior to any use or purchase from us.
IV. If you have any queries regarding our terms and conditions, please contact us before use or placing an order. The use of our website does not give you any intellectual right over it. Any copy or usage of our content without our prior agreement will be considered illegal and we will have the right to pursue legal lawsuit against you.
V. These terms and conditions also apply to any of our other social media platforms such as Facebook, Pinterest and Instagram.
VI. We have the right to delete any post or content we consider not suitable for our platform made by you or third parties.

1. About Tibako
1.1. Our website www.tibako.com is owned and operated by Tibako company registered in Jacques Veltmanstraat 109, 1065 DB Amsterdam, The Netherlands.
1.2. Tibako belongs to a private ownership.
2. Placing orders
2.1. To place an order, You can choose to create an account with us or becoming one time guest.
2.2. By creating an account and accepting our ‘Terms and Conditions’ policy you confirm that all provided information is accurate. At any time, you can access your customers account and change or update your personal information.
2.3. When creating your account for the security purposes you will be asked to create a password. Please note, that you are responsible for keeping your password confidential.
2.4. We are not liable for any loss or damage that may be the cause of your failure to protect your personal information. If you suspect any unauthorized activity with your account or personal information, please notify us.
2.5. In case we notice any suspicious activity from your account or possible fraudulent characteristics, we have the right to deny you access or even delete your account.
3. Accepting your order
3.1. After accepting your order, you will receive a confirmation email.
3.2. Items marked as ‘In stock’ will be dispatched to you as soon as possible.
3.3. Items, which have to be made first prior to the shipping, will take longer time for delivery, due to their manufacturing process, and according to the timeline you will be informed in the ‘Product Description’.
4.1. We accept PayPal and iDeal type of payment.
4.2. We will not ship any order if it has not been fully payed off.
4.3. By completing payment, you confirm that all card holder information is accurate and you are solely responsible for the usage of it.
4.4. Card payments will be subject to authorization from your card issuer and credit facilities subject to a credit check.
4.5. We do not store your payment information, however third parties (e.g. your card issuer) may store it using encrypted secure payment mechanisms. For that, you need to check the third parties website and their Terms and Conditions regarding your personal payment information data.
5.1. Our delivery timeline information is at best approximate information and we cannot be held responsible for any delay that may be a result by the delivery provider or the post office.
5.2. There is no minimum amount of product or price to order.
5.3. For all orders in the Netherlands delivery is free. For orders from other countries (please see the list of countries here), free delivery is acceptable when placing an order over 350 EUR.
5.4. Purchased items can only be delivered to you by mail and you cannot collect it in our store, since we only operate as an online shop.
5.5. We do not deliver worldwide, only in selected countries. The list and the shipping costs you can view here.
5.6. Any items that fall under specific custom and import regulations are not our responsibility but yours.
6.1. If you wish to return your order, you have to fill in the return form that you will receive with your package. After promptly packaged again, you will have to go to your nearest post office and leave the package there with the new delivery label on it.
6.2. The return costs are carried by the returner (that means You, the customer).
6.3. All returns must be shipped back to us within 14 working days after delivery.
6.4. All products have to remain unused, unwashed with original label and in original packaging to be returned. In case, you do not respect any of this conditions, we hold the right not to refund your money back.
6.5. If you damage or in any way change the original form of the product, it will be considered as your responsibility and it will not be considered for the refund.
6.6. For payments made with IDEAL it might take minimum of 5 working days to receive back your money. For purchases made via PayPal with your credit or debit card, the refund can take up to 30 days to show up on your account. If you bought the item using your bank account or PayPal balance, the balance will be credited to your PayPal Funds can take 3-5 days to arrive in your account.
Refund time, for both, IDEAL and PayPal are indicated by IDEAL and PayPal themselves and therefore Tibako is not responsible if there are any delays.
6.7. When returning items we only provide money refund, no item exchange.
6.8. We refund money only after we received the product.
7. Product descriptions
7.1. All our products have visual and descriptive information. We try our best to fairly represent them, but please note we are not responsible for minor visual diversities between real life and digital image changes that may occur.
7.2. We do not guarantee that you will receive exactly the same product as in the visual description, due to the fact that all our items are handmade and therefore each of them is unique. We try our best to reproduce all handmade items with quality and the same effect, but have in mind, every handmade item has a slightly different technique due to the fact that are not being made by robots or machines but by people.
7.3. All Tibako items under the label ‘Tibako’ are made specifically for us by women knitters, and therefore hand-knitted.
7.4. All other items made by other producers do not necessarily follow this condition. Some parts of the production might have used other materials and the help of machines, but still regarded as handmade due to the fact they are not considered to be industrial.
7.5. The size chart for now we do not have.
8. Privacy & Cookies policy
8.1. Any personal information we acquire from you, will be used for the purpose of using our website, maintaining your account, processing your order and shipment as well as sending you any promotional information and other forms of communication.
8.2. The personal information we might collect is: your name, last name, home address, email address, phone number, password, payment details (such as your payment card number, expiration date and card security code), shipping and billing information, purchase history and product preferences.
8.3. We process your personal data to the extent you have voluntarily supplied it to us, such as by filling in a contact form, by creating an account or by providing shipment and payment details which enables us to process your purchase or returns. The grounds on which we process your data are contractual necessity, legitimate interest and, to the extent required, your consent.
8.4. Any personal data obtained by us will be stored and secured with appropriate technical level of security against unauthorized or unlawful usage. However, no security system is perfect and we cannot guarantee the security of your personal data during transmission to us or security of your mobile device.
8.5. We also collect automated certain information over cookies, web server logs and web beacons; when you visit our website, via our social media pages or your mobile device.
8.6. We also may have a contract with third-party advertising networks (such as Facebook, Instagram, Pinterest and Mailchimp) that collect IP addresses and other information through cookies and web servers. From our side this part will be mostly used for analytics. Such as Google Analytics.
8.7. Google Analytics helps measuring how users interact with our website content. These cookies “remember” what our users have done on previous pages and how they’ve interacted with the website. For more information on Google Analytics, visit Google’s information page.
8.8. When it comes to Social media we use Facebook, Instagram and Pinterest as options for our customers to interact with us, follow us or receive promotional info about our latest news and products.
8.10. Cookies on our website are being used for your better shopping experience. They help us to determine your preferences and browsing experience.
8.11. To accept or deny cookies, you can choose with your first encounter on our website (that will appear in a pop-up box).
8.12. If you wish to deny your initial accept, you can always change your setting options.
8.13. The types of cookies we use are:
Performance cookies – which collect information about your use of our website. They do not collect information that identifies you as a visitor. The information these cookies collect is anonymous and is only used to improve how a website works.
Analytical cookies ̶ help us to determine how many users and website visitations we have in a considerable timeline. Also to record which content has been visited the most.
8.14. Please have in mind that by deleting or blocking cookies will have an impact on your user experience of the website. It may not function or allow you certain browsing usage.
8.15. Functional cookies are unavoidable.
8.19. When it comes to our payment transaction provider, Tibako uses services from Mollie for IDEAL and Paypal.
8.25. By complying with Tibako Terms and Conditions, you also comply to this mentioned vendors.
8.27. You, as a data subject, have a number of legal rights:
- Right of access. This means you can make a request to obtain access to the personal data concerning you.
- The right to rectification or correction of your personal data if it is inaccurate or incomplete;
- The right to erasure of the personal data that relates to you;
- The right to object to or to request restriction of the processing.
- The right to data portability. This means that you have the right to receive your personal data in a structured, commonly used and machine-readable format, and that you have the right to transmit that data to another controller;
- The right to object to profiling;
- The right to lodge a complaint with a supervisory authority;
- The right to withdraw your consent. However, there may be circumstances in which we are entitled to continue processing your data, in particular if the processing is required to meet our legal and regulatory obligations.

9. Care and Maintenance
9.1. Please read carefully care and maintenance description of any item before purchase.
9.2. We will not be responsible if any damage occurs by not following recommended instructions.
9.3. Since most of our materials come from a natural source such as wool, cotton, linen, silk, wood and leather, always make sure you have read the label before putting it into a washing machine or using strong detergents.
9.4. Wool has a natural tendency to loose hair or create pilling. This will not be considered for a complaint.
10.1. Any content from our website is protected against any commercial copyright.
10.2. You are not allowed to share, download, copy or transmit any information to the public in a way that is not visible from where is your source.
10.3. This does not include our posts from social media that you can share through your platform.
11. The Law
11.1. Any dispute or legal acquirements of Tibako are under the law and jurisdiction of the Government of The Netherlands.
